Our website policies are designed with you, the customer, in mind to ensure that your online shopping experience with Zdirect will be secure, prompt, efficient and hassle-free. As far as possible our online policies are consistent with our in-store company policies and procedures.

We value our customers and will do our best to foster and maintain a great relationship with you. We are committed to trading fairly and honestly at all times.

Terms of Sale and Conditions of use

These terms and Conditions of Sale apply to Zdirect, Dream Sleep, and Water Filters Direct North Shore Limited, all hereinafter referred to as “Zdirect” “we” “us or “our”. Zdirect and Dream Sleep are divisions of Water Filters Direct North Shore Limited.

By using this website or purchasing products from Zdirect (“Zdirect”, “we”, “us”, “our”), the purchaser (the “Customer”, “you”, “your”), acknowledge and agree to the following terms and conditions (the “Terms”).

We value our customers and will do our best to foster and maintain a great relationship with you. We are committed to trading fairly and honestly at all times.

Jurisdiction

All contracts formed between Zdirect and the Customer are governed by New Zealand Law, and specifically The Commerce Act, The Fair Trading Act, The Consumer Guarantees Act and The Sale of Goods Act.

Amendments

We may amend these terms and conditions from time to time, so you should check and read these terms of use regularly. By continuing to use this site after any such amendment, you are deemed to have agreed to the amended terms of use.

Consumer Protection and other legislation

Where the provisions of the Consumer Guarantees Act 1993 or any mandatory legislation in your jurisdiction that cannot legally be excluded applies, these terms will be read subject to the application of that legislation, and in the case of any conflict, the provisions of that legislation will apply.

Business Customers: To the extent permitted by law, business customers agree that where products are purchased for the purpose of a business that the Consumer Guarantees Act or equivalent consumer protection legislation does not apply.

Software Warranty: All software or other electronic or digital products (including DVDs) sold by Zdirect are subject to the terms and conditions of the license agreements that apply to those products. The Customer acknowledges their obligations to abide by such license agreements. Subject to any applicable law that cannot be excluded, the Customer acknowledges that Zdirect does not warrant any software or other electronic or digital products under these Terms and Conditions. All software and other electronic or digital products are warranted in accordance with the license agreement that governs its use.

Defective goods

In the unlikely event of defective goods we will, at our discretion, either replace or refund such faulty goods. Zdirect will comply with our obligations under the Consumer Guarantees Act or any other applicable consumer protection legislation that cannot be excluded. Subject to any such applicable laws, refunds or replacement products or services will be given at our discretion.

Incorrect Goods ordered

Within 14 days of purchase Zdirect may accept, at our discretion, a return of incorrect goods ordered by a customer providing the goods are in resalable as new condition, in other words, providing the goods have not been used and any sealed packaging has not been opened. A return authorisation is required and a restocking fee of up to 20% may apply however this fee will usually be waived providing the correct goods, or other goods, are ordered and paid for. (EXCEPTION. Sorry but there are no refunds on personal hygiene and grooming products for health reasons, AND games, DVDs and software for copyright reasons).

Change of Mind

We do not have to provide a refund if you change your mind regarding a purchase however if within 14 days of purchase we will try and work together for a solution. A restocking fee of up to 20% may apply or may be waived at our discretion.

Addressing

If a product is found to be mis-addressed by us then we shall be responsible for the re-delivery, replacement or refunding of the product. If you have given an incorrect or insufficient address, then Zdirect will not be obligated to refund or resend the product and all responsibility for retrieving those incorrectly addressed goods and correcting delivery will be borne by the Customer. We will offer advice suggestions and try to assist you.

Limitation of Liability

The Customer shall indemnify Zdirect against any loss of or damage to property or for data or software which is lost, corrupted, deleted or altered due to the act or omission of the customer. Zdirect shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services from us, even if we have been advised of their possibility. In no case shall Zdirect’s maximum liability exceed the cost of the relevant original order.

 
PRICES, PAYMENTS AND ORDERS

Pricing

Transactions will be billed in NZ dollars unless the order, payment, or transaction page says otherwise. Our available payment methods will be presented at the time of purchase.

Pricing and GST

For New Zealand delivery addresses, all prices are New Zealand GST inclusive unless otherwise stated. If your order ships to a delivery address outside New Zealand, no New Zealand GST is payable however what would otherwise be the NZ GST component of a product price and order may be used by us towards our shipping costs to Australia and other International destinations.

Title

Zdirect retains title in the products purchased until Zdirect has received payment in full.

Bank Account Number – payment by bank transfer

Zdirect gives the customer the choice to pay for products through bank transfer. If the Customer credits money to an incorrect bank account number, and the correct number was provided to the Customer by us, then we will not accept any responsibility for correcting payment and goods will not be dispatched by Zdirect until we have received payment in full.

Mailing Cash

Zdirect does not recommend that cash be mailed for payment of products. If the Customer does mail cash, Zdirect accepts no responsibility for the theft, loss or otherwise for non-delivery of the mailed cash.

Revision of Shipping Charges

Delivery charges are displayed when you choose your delivery method on the Shipping page prior to payment. We cannot anticipate all of the variations in ordering and in some instances we may have to contact you with revised shipping costs especially if your delivery is to remote areas or offshore international. If we do contact you with revised shipping charges and you are not happy you may cancel your order.

Customs & Duties

For any orders shipped outside of New Zealand the Customer is the importer of record and will be responsible for all customs import duties and sales tax charges. These charges vary in each country and are outside of our control. Contact your local customs office for more information on what import duties or sales taxes may be imposed. Generally imports less than AUD $1,000 are free of duty, taxes, import charges.

Price Match NZ

Our price match NZ pledge aims to match the price of New Zealand registered businesses. It excludes trade quotes, stock liquidations, fire sales, and commercial quantities.

Pricing Errors

Although we do our best to ensure prices stated on this website are accurate, errors do occur from time to time. Where a pricing error occurs (subject to applicable law that cannot be excluded), we will not be bound by the incorrect pricing stated, and reserve the right to cancel your purchase and refund any payment made.

Special Offers

Special deals and offers on this site, or by email, are only valid for so long as they are displayed, unless expressly stated otherwise.

Cancelling Orders

Zdirect reserves the right to cancel orders for any reason or to cancel the purchase agreement after order confirmation, including (without limitation) where we believe the order to be fraudulent or constitute a mis-use of a promotional or marketing activity or where an error has occurred including but not limited to errors relating to pricing. If we do cancel your order or purchase agreement, we accept no liability for any resulting damages or costs suffered by you, however we will refund the full purchase price to you (where it has already been paid).

Stock Availability

Zdirect stocks most products at our main base, however, in order to provide the greatest range of products, you understand that we may not stock all products listed on this site. All items sold via the Zdirect website are subject to availability and Zdirect reserves the right not to accept or cancel any order for products that are out of stock. Product availability information may be provided by third parties. Zdirect works with these third parties to ensure this information is as accurate as possible however some errors and omissions are expected. Goods delivered will be as described however both product and packaging updates may result in goods being supplied that may differ to the product images presented on this site.

Cash Rewards Discount Coupons

Cash Rewards (discount rewards and vouchers) can only be used as discounts on future orders and cannot be converted into a cash payment from Zdirect to the Customer or be used to purchase gift vouchers.

Gift Vouchers

Gift vouchers are valid for one year from the time they are issued, after which the voucher expires. Any credit remaining after the expiry of the gift voucher is non-refundable. Gift Vouchers are not redeemable for cash.

 
SHIPPING AND DELIVERY

Time to ship

Orders are usually processed and shipped out within 2 business days. Often orders placed in the morning can be shipped out the same day.

Time to Delivery

New Zealand shipping addresses delivery target is within 3 business days.
For Australia and the South Pacific the targeted delivery time ranges between 4 to 14 business days.
For USA and Canada, with Covid19 flight capacity reductions, we are seeing extended transit times and delivery may take 4 to 8 weeks.

Delivery Method

New Zealand: We use overnight courier. Delivery to some residential, remote or rural areas may take an extra day.
Our standard delivery method is courier “NO signature required” which means your item will be left even if your premises are unattended.
With this standard method we are not liable for any loss or missing items if the courier can provide evidence of delivery to your address. Evidence of delivery is usually the GPS position recorded at the time the package was scanned at the delivery address.

Signature Required Option

Alternatively if you prefer, or are concerned about the security of your item or have had any theft of items from your delivery address in the past, then please instruct us to send “Signature Required” You can do this by sending us a message using the contact us page or by sending an email immediately after you have placed your order.
Australia, South Pacific and elsewhere: Standard delivery method is Airmail. Sometimes we may send by courier.

Delivery Estimates

Zdirect makes every effort practical to ensure that delivery timeframes given are accurate. However the delivery times stated for products on this site assume that the stock availability information provided by our suppliers is accurate and that delivery times are not adversely affected by unforeseen events. By placing an order, you agree not to hold us liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.

Claims for non delivery or delivery of damaged goods

Claims for non delivery must be made as soon as possible. If you are concerned about any delivery delay of your order please contact us as soon as possible. In any event, for New Zealand customers, contact us within 5 business days of placing your order to enable us to comply with the requirements of our delivery providers (courier and post). Non delivery claim addresses may be registered with a national claims database. We reserve the right to require signature receipts or to cancel orders to what we consider to be high risk addresses. If your goods are received damaged contact us immediately and within 48 hours of delivery to enable us to comply with the terms of our delivery providers.
Non delivery claims will be progressed promptly. Proper investigations must be completed therefore non delivery claims may take 7 to 10 days to resolve and possibly longer if there are complications.

 
RETURNS

Returns and Exchange Policy

At Zdirect, we stand by the quality of our products and are committed to ensuring you are satisfied with your purchase. If you are not happy with something purchased from us, please let us know as soon as possible.

Defective goods

Return Process

In the first instance contact us by email and obtain a return authorisation number. If a return is required we will either send a courier bag out with your replacement order or post a courier bag to you for you to send back your return. Sending instructions for your return will be sent by email.

Communications and your Personal information

By creating an account with Zdirect you consent to receiving electronic communications from Zdirect. These communications will include: account status updates, order status updates, promotional and marketing materials, and other information relating to the service.
Your personal details will not be made available to any third party unless they are required by law or; in connection with your order, data processing, or payment, in which case it will be in accordance with our privacy policy. For more information please see our Privacy Policy.
